Keihanna Link Terms of Service

The Public Foundation of Kansai Research Institute (hereinafter the “Institute”) provides for the following Terms of Service (the “Terms”) to set out the terms and conditions for using “Keihanna Link” operated by the Institute (hereinafter the “Website”). When you use the Website, you need to consent to the Terms.

General Provisions
  1. The Terms apply to all relationships between the Institute and all users of the service (a collective term for the services that the Institute provides on the Website; hereinafter the “Service”) provided by the Institute on the Website.
  2. By using the Service, a user will be deemed to have consented that they will comply with the provisions hereof.
Change or Revision to Terms
  1. The Institute may change or revise the Terms from time to time without advance notice to users.
  2. For such change or revision of the Terms, when using the Service a user will refer to an announcement published on the Website or the latest version of the Terms provided on the Website. A user who uses the Service after such publication or provision will be deemed to have consented to the revised Terms of Service.
Change and Abolition of Service
  1. The Institute may change the contents of the Service in whole or in part without advance notice to users. The Institute may also discontinue or abolish the Service in whole or in part by providing a certain period of advance notice. However, in case of urgency, the Institute may discontinue or abolish the Service without advance notice.
  2. The Institute will under no circumstances be responsible for any disadvantage or damage incurred by a user or third party as a result of any change, discontinuation or abolition of the Service.
Temporary Suspension of Service
  1. The Institute may temporarily suspend the provision of the Service without advance notice to users for any of the following grounds.
  2. The Institute will under no circumstances be responsible for any disadvantage or damage incurred by a user or third party as a result of such suspension of the Service.
    1. When it is required due to a failure, maintenance, inspection, repair or servicing of any equipment, system, etc. that the Institute uses for services or other purposes
    2. When it is impossible to provide the Service due to a fire, power failure or other similar reason
    3. When it is impossible to provide the Service due to an earthquake, volcanic eruption, flood, tsunami, typhoon, heavy snowfall or other natural disaster
    4. When it is impossible to provide the Service due to a war, upheaval, riot, disturbance, terrorism, labor dispute, infectious disease or other similar reason
    5. When the Institute finds that it needs to temporarily suspend the provision of the Service due to any operational or technical reason
Maintenance of Usage Environment and Principle of Self-responsibility
  1. A user will arrange all equipment, software, means of communication and the like at their own responsibility and expense, and will establish and operate them appropriately to be used for the Service.
  2. The Institute will under no circumstances be responsible for any disadvantage or damage incurred by a user or third party as a result of any problem with a communication line or other cause that makes the Website inaccessible or interrupts the connection thereto.
  3. A user will be solely responsible, and the Institute will in no way be responsible, for their use of the Service and all acts made with the use of the Service and results of such acts.
  4. A user may post or provide only such information, content or other materials that have no possibility of interfering with the Service’s function or technical hindrance. A user shall not cause any problem or damage to content on the Service or the Website, or any other information or telecommunication system of the Institute, and shall not alter them without permission or cause them to become infected with a computer virus.
Prohibition of Unauthorized Use of Information
  1. The copyrights, trademark rights and other intellectual property rights, image rights, publicity rights, and any other rights pertaining to all or part of the information provided through the Service and other contents constituting the Website shall be vested in the Institute or the respective legitimate right holders.
  2. A user may use the Service only to the extent permitted by the purposes of the Service, the Terms and relevant laws, and may print out its content only for their own use.
  3. Without the advance consent of the Institute or the legitimate rights holder, a user will not engage, for whatever reason, in (i) transfer, editing, adaptation, use, reproduction, redistribution, public transmission or forwarding of all or part of the information provided through the Service or other contents constituting the Website or any other similar acts, by electronic or mechanical means or by any other means, or (ii) the provision of such information or contents to any third party through such acts or by printing them out, and a user will not imitate the Service or the Website, use any know-how contained in the Service or the Website, or infringe, regardless of the method, the rights set forth in paragraph 1./li>
Prohibition of Inappropriate Posting and Acts
  1. In using the Service, a user will not post any content or engage in any act that falls or is likely to fall under any of the following items regardless of the form of the act, whether intentionally or by negligence:
    1. Posts or acts that are contrary to public order and morals;
    2. Criminal acts or encouragement of such acts, or posts or acts that imply execution of such acts;
    3. Posts or acts that infringe any intellectual or other property right, privacy right, image right, or other right of the Institute, another user or a third party, or other acts that inflict economic loss on them;
    4. Posts or acts that slander the Institute, another user or a third party or are likely to damage their reputation or inflict mental damage on them;
    5. Posts or acts that damage the good name of the Institute, another user or a third party, and are likely to cause credit uncertainty thereof;
    6. Posts or acts that violate any laws and regulations, or equivalent guidelines or rules;
    7. Posts or acts that cause a nuisance or unwell feeling to the Institute, another user or a third party;
    8. Posts or acts that interfere with the operation of the Service or the Website, or other operation of the Institute, or damage the credibility of the Institute;
    9. Posts or acts that violate the Terms; or
    10. Other posts or acts that the Institute finds are inappropriate as a user of the Service.
Preservation of Posted Information and Guarantee
  1. The Institute does not guarantee that information posted by a user using the Service will be surely recorded or preserved. The Institute will under no circumstances be responsible for any loss, alteration or leakage of such information in whole or in part arising for whatever reason. The Institute may delete or destroy any posted content at its own discretion.
Membership Registration
  1. Part of the Service (hereinafter the “Member Service”) may become available upon membership registration.
  2. A “Member” means a user approved by the Foundation who, having consented to the Terms, makes registration through a designated procedure to use the Member Service of the Institute. The procedure for membership registration will be carried out by the user becoming a Member.
  3. If the screen providing a Member Service provides individual terms for that service, including under the name of “Terms,” “Guidelines,” “Points to Note,” “Notes,” “Prohibitions,” or “Rules” (hereinafter the “Individual Terms”), by using the service a user will be deemed to have consented to the Individual Terms unless provided for otherwise.
  4. A Member may hold only one account. Unless separately approved by the Institute, a Member may not hold more than one account.
Requirements for Membership
  1. A user satisfying the following conditions will be eligible for membership registration for the Service:
    1. Consenting to the Terms;
    2. Not being or having been an antisocial force now or in the past, not having used an antisocial force, and not having a major stakeholder or executive who is a member of an antisocial force; or
    3. Not having had their membership for the Service cancelled or their usage denied.
  2. If the Institute finds that any item of paragraph 1 is violated, the Institute may cancel membership.
Registered Information of Member
  1. At the time of registration of membership, a user will enter the true, accurate and latest information of the user, and will submit it to the Website. When there is any change to the registered information, a Member will confirm it and promptly submit notice to the Institute by the designated method, so that the latest information will always be kept true and accurate.
  2. Should the Institute find that the foregoing is violated, or a Member fails to submit true and accurate latest information, the Institute may cancel or temporarily suspend their membership, or may deny future use of the Service to them.
  3. If the screen providing a Member Service provides individual terms for that service, including under the name of “Terms,” “Guidelines,” “Points to Note,” “Notes,” “Prohibitions,” or “Rules” (hereinafter the “Individual Terms”), by using the service a user will be deemed to have consented to the Individual Terms unless provided for otherwise.
Registered Corporation
  1. A corporation who desires to post information to seek new business partners or exchange information on the Website needs to be registered as a Registered Corporation.
  2. A “Registered Corporation” means a corporation approved by the Foundation who, having consented to the Terms, makes registration through a designated procedure to use the Registered Corporation Service of the Institute. The procedure for membership registration as a Registered Corporation will be carried out by the representative who serves as a point of contact at the corporation.
  3. The information entered at the time of registration will be shared for the sites and services related to the Website, in addition to the Registered Corporation Service.
  4. A Registered Corporation may hold only one account. Unless separately approved by the Institute, a Member may not hold more than one account.
Requirements of Registered Corporation
  • A corporation satisfying any of the following conditions will be eligible as a Registered Corporation of the Service:
    1. Corporations, universities, research institutions and bodies located within the area of the Kansai Science City
    2. Corporations, universities, research institutions and bodies that are tenants of the incubation facilities located within the area of the Kansai Science City
    3. Corporations, universities, research institutions and bodies that are tenants of (1)
Disclaimer
  1. The Institute will not provide any representation or warranty whatsoever with respect to any information provided through the Service or on the Website (hereinafter collectively “Provided Information”) regardless of whether it is information based on posts of users, and the Institute in particular does not check its contents, quality, accuracy, legality, usefulness, credibility, immediacy or completeness, not undertaking the obligation to check it or providing any representation or warranty whatsoever for it.
  2. The Institute will in no way be responsible for any damage caused to a user or third party resulting from their use of Provided Information or unavailability of Provided Information of the Institute.
  3. The Institute will in no way be responsible for any dispute arising between users or a user and a third party (including those arising out of infringement of intellectual property rights) or any damage caused to a user or a third party due to any act of any third party in connection with the Service or the Website.
  4. The Institute will not be involved in any discussions or transactions between Members triggered by the Service or the Website.
  5. The Institute will in no way be responsible for any damage to a computer, communication line, software or the like arising due to any download or computer virus from the Service, the Website, or any other website of a third party, including an advertiser.
  6. If the Institute incurs any expenses or pays any damages or other money in responding to any claim or complaint arising out of or in connection with a user’s violation of the Terms, the user will bear all such expenses, damages or other money (including attorney’s fees paid by the Institute).
  7. In addition to the preceding paragraphs, the Institute will in no way guarantee the contents, quality or standard of the Service or the Website, or the stable provision of the Service, nor will it compensate for any result of the use of the Service.
Effect of Terms
  1. The Terms will take effect from the time they are published on the Website, and any revised Terms will take precedence over the previous Terms and be applicable.
  2. Any obligations of a user that have arisen hereunder before the termination shall survive the termination of the Service, the Website, their use of the Service, or these Terms.
